IMPORTANT: Please read these Terms carefully. If the learner is under 18, the parent or legal guardian who purchases or authorizes access must accept these Terms on the learner's behalf and supervise the learner's use of the Services.
1. Acceptance of These Terms
These Terms of Use (the "Terms") form a binding agreement between Racing Future Management LLC ("Racing Future," "we," "us," or "our") and the adult purchaser, parent, legal guardian, school, organization, or other authorized user who accesses or uses the STEAM Racing Future online platform, website, courses, videos, lesson materials, worksheets, quizzes, community features, and related services (collectively, the "Services").
By creating an account, purchasing a course, clicking to accept these Terms, or using the Services, you agree to these Terms and acknowledge our Privacy Policy and any checkout terms shown at the time of purchase. If you do not agree, do not access or use the Services.
If you accept these Terms for a company, school, or other organization, you represent that you have authority to bind that organization. Any signed order form or separate written agreement controls over these Terms to the extent of a direct conflict.
2. Educational Purpose and Scope
STEAM Racing Future is an educational program that uses motorsport and step-by-step go-kart construction concepts to teach science, technology, engineering, arts, and mathematics. The Services are for educational and informational purposes only.
The Services do not provide professional engineering certification, mechanical certification, driver training, legal advice, medical advice, or a guarantee of academic, athletic, admissions, employment, or career results. Completion of a course does not qualify a learner to construct, repair, inspect, operate, or race a vehicle without appropriate adult supervision, professional instruction, safety equipment, and compliance with applicable laws and facility rules.
3. Eligibility; Learners Under 18
The courses are designed primarily for learners ages 10 through 16. A learner under 18 may use the Services only with the permission and supervision of a parent or legal guardian, or through a participating school or organization acting with appropriate authority.
Only an adult age 18 or older may purchase a course, enter payment information, accept recurring billing, or create and control a family account. The adult account holder is responsible for the minor learner's use of the Services and for ensuring that all information supplied is accurate.
For a learner under age 13, the parent or legal guardian must create or authorize the account and complete any verifiable parental consent process required by the Children's Online Privacy Protection Act and its implementing rule ("COPPA"). We may restrict, suspend, or delete access if required consent is not obtained or cannot be verified.
4. Accounts and Account Security
You must provide accurate, current, and complete information and keep it updated. You are responsible for safeguarding account credentials and for activity under your account. Notify us promptly at monika@steamracingfuture.com if you suspect unauthorized access.
Unless an order form expressly permits a classroom, school, or multi-user license, each account and license is assigned to one learner and may not be shared. You may not sell, transfer, sublicense, or allow another household, learner, employee, or third party to use your credentials.
5. Course Access and Limited License
Subject to payment and compliance with these Terms, we grant the authorized learner a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the purchased course and its materials solely for personal, noncommercial educational purposes during the access period stated on the applicable sales page or order form.
A school or organizational license is limited to the number of instructors, learners, classrooms, sites, and access period stated in its order form. No institutional use is permitted under an individual or family purchase.
Course access begins after successful payment or as otherwise stated at checkout. Access periods, release schedules, included downloads, certificates, and support features may vary by offering and will be described on the relevant sales page or order form.
6. Purchases, Prices, Taxes, and Payment Processing
Prices, currency, taxes, billing frequency, and included features are disclosed at checkout. You authorize us and our payment processor to charge the selected payment method for all amounts disclosed before purchase. You are responsible for applicable taxes unless the checkout page states that they are included.
Payments may be processed by Stripe or another third-party payment processor. We do not receive or store full payment-card numbers. The payment processor's terms and privacy practices also apply to its processing activities.
If a payment is declined, reversed, disputed, or overdue, we may suspend access after providing any notice required by law. You remain responsible for valid charges and any undisputed outstanding balance.
7. Subscriptions, Automatic Renewal, and Cancellation
If you select a subscription or installment plan, the checkout page will clearly disclose the amount, billing frequency, subscription term, renewal terms, and how to cancel before you submit payment. By affirmatively enrolling, you authorize recurring charges to your selected payment method until the subscription ends or is canceled.
You may cancel recurring billing through the account settings made available on the Platform or by emailing monika@steamracingfuture.com. Cancellation stops future recurring charges but does not automatically refund charges already incurred. Unless otherwise stated at checkout, access continues through the end of the paid billing period.
We will provide confirmations, renewal notices, or other disclosures when required by applicable law. If the checkout offer is a fixed installment plan for a defined course rather than a cancel-anytime subscription, canceling platform access does not eliminate payment obligations that were clearly disclosed and accepted at purchase, except where applicable law requires otherwise.
8. Refund Policy
Refund eligibility is governed by the refund terms displayed at checkout and any separate Refund Policy incorporated into the purchase. Except as expressly stated there or required by law, fees are nonrefundable after access to digital course content has been provided.
Nothing in these Terms limits rights that cannot lawfully be waived, including rights relating to unauthorized charges, materially defective digital services, or any mandatory cancellation or refund right under the law applicable to the purchaser.
9. Acceptable Use
You and the learner may use the Services only for lawful educational purposes. You may not:
copy, reproduce, record, screen-record, photograph, scrape, download, distribute, translate, modify, publicly display, publish, sell, license, or create derivative works from course materials except where we expressly authorize it in writing;
share logins, bypass access controls, probe security, introduce malware, use bots, or interfere with the Platform or another user's access;
use materials to create or deliver a competing course, commercial training, model training dataset, or other commercial product;
post unlawful, infringing, threatening, harassing, hateful, discriminatory, sexually explicit, deceptive, or unsafe content;
impersonate another person, misrepresent age or authority, collect personal information from another minor, or attempt private contact with a minor without appropriate authorization; or
encourage dangerous driving, unsafe mechanical work, evasion of track rules, or violation of law.
10. Community Features and User Content
If the Services include comments, chat, project uploads, or other interactive features, you retain ownership of content you submit ("User Content"). You grant Racing Future a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, and display User Content solely as reasonably necessary to operate, secure, moderate, and improve the Services and to provide the course to you. We will not use a minor's name, image, voice, project, or testimonial in public marketing without any consent required by law.
Do not submit sensitive personal information, precise location, private contact details, or images or recordings of a minor unless the Platform expressly requests them and the responsible adult has authorized the submission. We may review, restrict, remove, or report User Content that violates these Terms or creates a safety or legal risk. We do not guarantee that all User Content will be monitored.
11. Intellectual Property
The Services and all associated course designs, curricula, lesson plans, videos, graphics, illustrations, animations, quizzes, worksheets, text, software, branding, trademarks, logos, layout, and know-how are owned by Racing Future or its licensors and are protected by U.S. and international intellectual-property laws. Except for the limited license in Section 5, no right, title, or interest is transferred to you.
STEAM Racing Future™, Racing Future, and associated logos are trademarks or service marks of Racing Future or its licensors. You may not use them without prior written permission. Any feedback you voluntarily provide may be used by us without restriction or compensation, provided that we do not publicly identify a minor without required consent.
12. Copyright Complaints
If you believe content on the Services infringes your copyright, send a written notice to monika@steamracingfuture.com containing: identification of the copyrighted work; identification and location of the allegedly infringing material; your contact information; a statement of good-faith belief that the use is unauthorized; a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act; and your physical or electronic signature.
13. Safety; Adult Supervision
Motorsport, vehicle construction, tools, machinery, batteries, fuels, and track activities can involve serious risks. The online course is not a substitute for hands-on supervision by a qualified adult or professional. A responsible adult must assess each activity, workspace, tool, component, and learner's ability before any physical activity begins.
Learners must follow manufacturer instructions, applicable laws, facility and track rules, and all safety guidance. Do not operate a go-kart or other vehicle on public roads or in an unsafe location. Do not perform welding, fuel handling, battery work, engine work, lifting, cutting, drilling, or other hazardous activity without competent adult supervision and appropriate protective equipment.
If a separate in-person event, track session, or driving activity is offered, additional participation agreements, safety rules, releases, and venue terms may apply. These Terms alone do not enroll a learner in an in-person activity.
14. Privacy and Children's Privacy
Our collection, use, disclosure, retention, and protection of personal information are described in the Privacy Policy and, where applicable, a Children's Privacy Notice. Those notices are incorporated by reference for notice purposes but are not intended to reduce any privacy rights provided by law.
For children under 13, we will provide direct notice to a parent or legal guardian and obtain verifiable parental consent before collecting, using, or disclosing the child's personal information when COPPA requires it. Parents may request access to, correction or deletion of, or an end to further collection of their child's personal information, subject to lawful verification and exceptions. We do not condition participation on disclosure of more personal information than is reasonably necessary.
State privacy laws may give eligible residents additional rights. Instructions for submitting privacy requests and appeals will be stated in the Privacy Policy. Consent to processing that legally requires separate consent will not be obtained solely through acceptance of these Terms.
15. Third-Party Services and Links
The Services may rely on or link to third-party platforms, video hosting, analytics, email, payment, or other services. Third parties may have their own terms and privacy notices. We are not responsible for third-party services that we do not control, but this clause does not limit responsibilities that applicable law places on us for service providers acting on our behalf.
16. Course Updates and Availability
We may update course content, instructors, examples, features, schedules, or technical requirements to maintain accuracy, safety, or quality. We may temporarily interrupt the Services for maintenance, security, or events beyond our reasonable control. We will not materially reduce a paid course during its stated access period without providing a reasonable substitute, remedy, or refund when required by law.
17. Suspension and Termination
You may stop using the Services at any time. We may suspend or terminate access for a material breach of these Terms, nonpayment, fraud, infringement, security risk, unsafe conduct, or conduct that threatens another user. When reasonably appropriate, we will provide notice and an opportunity to cure before termination, except where immediate action is reasonably necessary to protect users, minors, the Services, or legal rights.
Upon termination, the license in Section 5 ends and you must stop using restricted course materials. Sections that by their nature should survive will survive, including payment obligations, intellectual property, disclaimers, limitations of liability, indemnification, dispute terms, and general provisions.
18. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." RACING FUTURE DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR SUITABLE FOR EVERY LEARNER OR DEVICE.
SOME STATES DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. THIS SECTION DOES NOT LIMIT ANY NONWAIVABLE CONSUMER RIGHT.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RACING FUTURE AND ITS AFFILIATES, MANAGERS, MEMBERS, EMPLOYEES, CONTRACTORS, INSTRUCTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITIES, ARISING FROM OR RELATING TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RACING FUTURE'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO RACING FUTURE FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US $100.
THE LIMITATIONS IN THIS SECTION DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED, INCLUDING AS APPLICABLE LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR PERSONAL INJURY CAUSED BY NEGLIGENCE WHERE SUCH LIMITATION IS PROHIBITED.
20. Indemnification by Adult and Organizational Users
To the extent permitted by law, an adult user, school, or organization agrees to defend, indemnify, and hold harmless Racing Future and its affiliates, managers, members, employees, contractors, instructors, and licensors from third-party claims, damages, judgments, losses, and reasonable legal fees arising from that user's material breach of these Terms, unlawful User Content, infringement of another person's rights, or unauthorized or unsafe use of course materials. This obligation does not apply to a minor learner and does not cover claims caused by Racing Future's own negligence, willful misconduct, or violation of law.
21. Electronic Communications
You consent to receive transaction-related notices electronically, including purchase confirmations, account notices, parental-consent communications, policy updates, and service messages. You may withdraw consent to marketing communications at any time through the unsubscribe method provided. Withdrawing marketing consent does not prevent necessary transactional communications.
22. Changes to These Terms
We may update these Terms to reflect changes in law, safety practices, technology, or the Services. We will post the updated Terms with a revised effective date and provide additional notice when required by law. Changes will apply prospectively. If a material change affects an active paid subscription, any right to reject or cancel will be provided as required by applicable law.
23. Governing Law and Dispute Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except that applicable federal law controls federal issues and mandatory consumer protections of your state of residence remain available to the extent they cannot lawfully be waived.
Any dispute arising from or relating to these Terms or the Services that cannot be resolved informally will be brought exclusively in the state courts located in New Castle County, Delaware, or the United States District Court for the District of Delaware, and the adult parties consent to personal jurisdiction and venue there. This venue provision does not apply where applicable consumer law gives an individual a nonwaivable right to bring a claim elsewhere.
Before filing a lawsuit, an adult party should send a written notice describing the dispute and requested relief to the contact information in Section 25 and allow 30 days for a good-faith attempt to resolve it. This informal process does not extend any statute of limitations unless the parties agree in writing.
24. General Provisions
These Terms, the Privacy Policy, the Children's Privacy Notice where applicable, the checkout disclosures, and any applicable order form constitute the entire agreement concerning the Services. If any provision is held unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, reorganization, sale of assets, or by operation of law, subject to applicable law. Headings are for convenience only. "Including" means "including without limitation."
Nothing in these Terms creates an employment, agency, partnership, joint venture, fiduciary, or franchise relationship. Neither party is liable for delay caused by events beyond its reasonable control, except that this does not excuse amounts already due or obligations relating to privacy, data security, or safety that remain reasonably capable of performance.

STEAM Racing Future™ | Terms of Use
Pre-Publication Review Notes
This page is an internal implementation checklist and should be removed before the Terms are published.
Confirm the Company's exact legal mailing address and whether 16192 Coastal Highway is a separate registered-agent address. Do not combine two addresses into one line.
Confirm the legal entity's exact Delaware name and good-standing status.
Insert live links to the Privacy Policy, Children's Privacy Notice, Refund Policy, and any school license terms.
Implement a COPPA-compliant direct notice and verifiable parental-consent workflow before collecting personal information from learners under 13.
Ensure checkout clearly states the total price, billing cadence, renewal or fixed-installment structure, access period, refund rules, and a simple cancellation method before payment details are collected.
Decide whether comments/chat will be enabled for minors; implement moderation, reporting, retention, and safety controls consistent with the published policy.
If relying on the DMCA safe harbor for user-posted content, register a designated agent with the U.S. Copyright Office and publish the agent's required contact information.
Have qualified U.S. counsel review the disclaimers, liability cap, indemnity, venue clause, state-specific consumer requirements, and any physical kart-building or track activities.
